Summerseat Players Terms & Conditions
1. Definitions
“Contracts” means any contract for the purchase of Tickets and/or Season Tickets made between you and Summerseat Players (including where purchased via TicketSource).
“Discount Code” means the unique code issued to the Lead Booker to secure a seat or seats at a discount to the full price fixed by Summerseat Players from time to time.
“Lead Booker” means the person responsible for securing the Season Tickets from Summerseat Players on behalf of an individual or group and is usually given to mean the person securing the seats for a performance for the individual or group.
“Priority Access Period” means the period which is opened solely to Season Ticket holders ahead of release for sale to the general public. This will usually be no less than one calendar week.
“Performance” means each play performed at the Theatre on the Main Stage. Please note that Studio productions are excluded from our Season Ticket scheme.
“Season Ticket” and “Season Ticket Scheme” relates to any pre-paid ticket(s) sold and issued to the Lead Booker (who by payment of a lump sum at the commencement of the Theatre’s season) has entitlement to one or more Season Ticket (depending on the amount purchased at a discounted price) for the purposes of holding season tickets for an individual or group for each Main Stage Production as specified by Summerseat Players during the applicable season.
“Summerseat Players” means Summerseat Players Ltd whose registered and principal address is the Theatre Royal, Smithy Street, Ramsbottom BL0 9AT. Summerseat Players is Registered in England and Wales under Company No: 2555263 | Charity No: 1000931 | VAT No: GB973713594.
“The Theatre” means the Theatre Royal, as listed at the above address.
“Ticket” means any ticket purchased for attending a live, stated performance of a theatrical nature on our Main Stage, Studio, or other performance space determined by Summerseat Players.
2. Agreement
These terms and conditions relate to the purchase and supply of Season Tickets or to direct purchases made via our booking agent, Ticketsource. TicketSource operate their own Customer Purchase Policy, which can be accessed here: www.ticketsource.co.uk/kb/terms-of-use/customer-purchase-policy
Tickets are offered for sale subject to availability. All ticket prices quoted by Summerseat Players in print and online are subject to change at any time.
Please read these terms and conditions, and those including in the TicketSource Customer Purchase Policy carefully before purchasing any Season Tickets, standard tickets, or making your booking, as by doing so, you accept that these terms and conditions will govern all Contracts.
Pre-paid tickets bought as part of our Season Ticket Scheme are eligible only for our Main Stage shows advertised by Summerseat Players as being part of the Season Ticket scheme.
Season Tickets must be purchased in advance direct with Summerseat Players in order to secure the discounted rate. No Season Tickets may be purchased after closure of the first production in any given season.
Completion of the Season Ticket Booking Form (including, for the avoidance of doubt, the provision of your credit or debit card details), or in the case of personal callers at the Box Office, the tender of cash or a cheque for the purchase of Season Tickets, shall constitute an offer by you to purchase Season Tickets subject to these terms and conditions.
Where you are a Season Ticket Holder claiming a “free” Ticket when making your booking online or direct with the Box Office (having pre-paid in advance), you agree that such booking is in accordance with these terms and conditions and that you are entitled to book the same.
Summerseat Players reserves the right to make ticket offers in addition to those published in brochures or on websites, and to withdraw them at any time. Discounted offers may be withdrawn at any time and without prior notice.
3. Refunds, Exchanges & Cancellations
Customers who advise us in advance of 48 hours before an event may exchange their ticket for another performance in the same advertised production run, subject to availability.
No full of partial refunds will be issued by Summerseat Players. Other ticket exchange and refund conditions apply. Please see TicketSource’s Customer Purchase Policy for details.
When purchasing a ticket via TicketSource, in order to be eligible for a refund, you must have bought ticket protection. Your transaction and refund request in these circumstances is with TicketSource. In the event of requesting a refund (rather than an exchange), we regret that we are usually unable to give refunds, except in exceptional circumstances or unless the event is cancelled in its entirety by us. Please contact us directly if you consider your circumstances warrant a refund.
Requests to our Box Office for changes or adjustments to be made to ticket orders should be made by the person named on the booking. We regret that we are usually unable to accept such requests from other parties.
You may elect to transfer your Ticket or Season Ticket to another person or persons, should you wish to do so, and this must be via your own arrangements. However, all tickets may not be transferred or resold for commercial purposes or at a premium. If a Ticket is transferred or resold in breach of this condition, the ticket(s) will be voided and the bearer of the Ticket or the person claiming the right to attend the event may be refused admission to the performance or event and any agreement you may have with Summerseat Players may be terminated.
By entering into an agreement to purchase a pre-paid Season Ticket, you agree to accept a discounted ticket price in exchange for securing a seat for one performance per Main Stage production as advertised by Summerseat Players as included in the Season Ticket Scheme. Should you elect not to attend a particular production, no full refund or partial refund will be due to you.
Summerseat Players reserves the right to utilise a seat for which a Ticket has been sold which remains empty immediately prior to curtain-up, in order to accommodate a potential audience member when all other seats are taken, unless you have advised the Box Office in advance that you will be late in arriving. No credit or refund can usually be claimed for Tickets which you have been unable to use for whatever reason.
If a performance is cancelled or rescheduled by us, Summerseat Players will use all reasonable endeavours to notify customers of the cancellation.
In the event of cancellation by Summerseat Players, all TicketSource bookings will be automatically refunded with a credit to the value of the booking to the original method of purchase. Season Ticket holders will be contacted by Theatre personnel to make arrangements for a refund or booking transfers.
If a performance is rescheduled, customers will be offered tickets to the rescheduled performance, equivalent to the face value of their original ticket.
In the unlikely event of a ‘show interruption’ during a performance, all efforts will be made to recommence the performance in original or adjusted format. Customers are advised that, except in exceptional circumstances, no refunds or compensation will be offered for performances that recommence and continue to conclusion.
In the unlikely event of an abandoned, cancelled or re-scheduled performance refunds for any unconsumed interval orders on presentation of the relevant order receipt will be made to the purchaser.
Changes to Coronavirus restrictions: We continue to keep our safety measures under review and will update our procedures in line with any new guidance or requirement issued by local or central governments. Please check our website before you visit for any recent updates. For the safety of others and to assist the continuation of performances, no one with symptoms of Covid or who has been asked to self-isolate should attend the Theatre. You may exchange your tickets up to 48 hours before a performance for another performance in the same advertised production run, subject to availability.
4. Responsibilities
If you book Tickets or Season Tickets on behalf of others, you agree to accept these terms and conditions on behalf of all members of the group and are responsible for all payments due from the party.
It is your responsibility to check that your booking is correct and that any Tickets issued to you are accurate in accordance with your booking request.
It is the audience member's responsibility to ensure tickets in their possession are for the correct date and time; please check your tickets carefully as mistakes cannot be rectified after the event. Audience members attempting to use tickets for an incorrect date or time will not be admitted to the Theatre.
To be admitted to the Theatre, you must be in possession of a valid Ticket. The Lead Booker is requested to ensure that all members of their party are in possession of a valid ticket to gain entry.
We strongly encourage Season Ticket holders to book their seats within the Priority Access period in order to secure their preferred performance date and seat(s) in the auditorium. Season Ticket holders will continue to be able to book tickets whilst general tickets are on sale but Summerseat Players accepts no liability for any failure on your part to secure tickets within the Priority Access period, or, once on general sale should performances become sold out. No refund will be offered to you should this occur.
Summerseat Players reserves the right to place restrictions on:
1. The number of Season Tickets sold to any individual party; and/or
2. The total number of Season Tickets sold in any season.
Information regarding a performance is correct at the time of publication. Summerseat Players shall be entitled to make changes as to performances, programme details, performers, running times and such other matters as it thinks fit in the case of any event or circumstances beyond the Theatre’s control.
Completion and submission of the online booking details on TicketSource on behalf of Summerseat Players shall constitute an offer by you to purchase Tickets subject to these terms and conditions.
The person making the booking is entirely responsible for entering all details correctly on the online booking and any additional information requested.
The price of an individual Ticket and Season Ticket is as determined by Summerseat Players ahead of the start of each season of plays.
You are advised to buy tickets only direct via our Box Office or online from our pages on TicketSource. Summerseat Players politely advises that, should any of our supporters purchase tickets offered from a third party (other than TicketSource), or other than direct from our Box Office, we cannot be held responsible for any losses.
Summerseat Players are not liable for any losses incurred by you in connection with your use of our website or bookings made with us via TicketSource, or for any delay in using or your inability to use the website and/or TicketSource.
Summerseat Players reserves the right to refuse admission and may request any ticket holders leave (taking any such appropriate action which may be necessary to enforce this right) before or during performances if it considers it to be necessary or desirable to do so for the comfort, safety and enjoyment of other audience members and/or our volunteers.
Latecomers may be asked to wait until a suitable break in the performance before being admitted to the auditorium. Latecomers may be asked to sit in seats other than those booked. On some occasions, it may not be possible to admit latecomers until the interval. Every effort will be made to admit latecomers at a suitable break in the performance, but admission cannot always be guaranteed.
Latecomers and non-attenders will not be offered refunds, regardless of the reason for the late arrival or non-attendance. This includes, but is not limited to, adverse weather, traffic congestion and public transport problems.
Re-entry to the Theatre or auditorium will be permitted only on production of a valid ticket.
You may only sit in the seats for which you have a confirmed booking, unless asked to by, or in agreement with, one of our volunteers or Front of House personnel.
5. General Terms & Conditions – Consideration for Audience Members and Others
Please note that our bar may be closed during or after a performance on certain nights of the week.
Alcohol purchased by audience members outside of the venue is not permitted inside the Theatre or auditorium and will be confiscated. Alcohol purchased at the Theatre may not be taken off the premises.
Glass containers may not be brought into the auditorium. Please return or exchange any glass containers for re-usable plastic containers at the bar before taking your seats.
Confectionery is permitted inside the venue, with the exception of those in glass or ceramic containers. However, we ask for your consideration whilst consuming confectionery during a performance, both for other audience members and for the actors. Please take any rubbish or disposable items with you when you leave.
Hot drinks are not permitted in the auditorium, but may be consumed in the foyer and bar areas.
The taking of photographs, capturing of images or the use of any recording devices (including but not limited to mobile telephones) by an audience member during any performance is strictly prohibited.
Mobile phones and other electronic equipment must be switched off before the commencement of a performance.
Audience members should please note that strobe lighting, smoke effects, weapons, guns, gunshots and other special effects are sometimes used in productions. Summerseat Players will endeavour to publish 'technical trigger' warnings.
Some productions may contain strong language, violence and/or themes of an adult nature. We will endeavour to give audiences suitable 'trigger' warnings should this be the case, however, we do not accept any liability for failure to do so or failure to receive such warnings. The Theatre Royal, Ramsbottom is a non-smoking venue. Smoking, including the use of electronic cigarettes, is not permitted anywhere in the Theatre, save for on stage when required by the Production.
All attendees must comply with all relevant statutes, safety announcements and venue regulations whilst attending a performance. Breach of any of these conditions or any unacceptable behaviour likely to cause damage, nuisance or injury will result in the individual being ejected from the venue, and no compensation or refund will be offered.
Customers with medical requirements necessitating the need for assistance should contact the Theatre in advance of their visit so that suitable arrangements can be made with volunteers, where possible. Failing this, we will endeavour to make suitable arrangements upon your arrival but can offer no guarantee of assistance.
Audience members may transfer into a theatre seat from a wheelchair, however for safety reasons customers must be able to evacuate without staff intervention in the event of an emergency.
In support of the Equality Act 2010, audience members with learning disabilities who do not use expressive or receptive language techniques will not be asked to leave a performance due to any behaviour that is a direct result of their disability. Volunteers will endeavour to offer and provide support where possible and a break-out space (where available), should it be required.
No animals are permitted in the Theatre, with the exception of assistance dogs.
We actively observe and support equality, diversity and inclusion. Should you need any of this information in a more accessible format, or have any concerns or suggestions about how we may make improvements for your safety and comfort, please contact us.
For most performances, unless otherwise advised, we regret children aged under five years old are not permitted in the auditorium. Children aged five and over must have a full-priced ticket, except where a concession is advertised by us.
Children, school parties, youth groups and those in need of special care are the responsibility of their parents, guardians, teachers and personal assistant (carers) who must ensure appropriate behaviour is followed in the venue. Should a child or person in need of special care become restless and cause a disturbance, the parent/guardian will be requested to leave the auditorium with the child. We reserve the right to not re-admit.
Regrettably, we are unable to offer baby changing facilities at the Theatre Royal.
For reasons of Health and Safety, all children aged 13 years and under must be accompanied by a responsible adult (aged 18+) at all times, unless they are present as a member involved in a performance, or attending the Theatre for the purposes of a Summerseat Players’ Young Company session or event, for which a risk assessment will be conducted.
Any published advice about age suitability for any productions is offered as a guide. It is the responsibility of the parent/guardian to determine the suitability of the event for their child.
We take the safety of our venue very seriously and we want all of our audience members and volunteers to feel confident to attend the Theatre and enjoy our live events. Summerseat Players therefore reserve the right to take additional security measures as deemed necessary and/or appropriate, including bag searches where there is considered to be suspicious activity.
There is no bag storage available at the Theatre, therefore audience members are asked to bring only what they need to the Theatre. Customers are prohibited from bringing holdalls, luggage, computer bags and laptops. Bags must be able to fit under your seat without causing an obstruction.
Please keep personal items with you at all times. The Theatre Royal does not accept responsibility for any loss or damage to personal property or items.
The Theatre does not offer any parking or bike storage facilities. Anyone attending the Theatre is advised to make suitable travel arrangements, noting public transport limitations and personal access requirements.
6. Publicity, Website and Other Communications
All details in Summerseat Players programmes, event flyers, brochures, newsletters, website pages and other communications are correct, errors and omissions excepted, at the time of publishing. Summerseat Players reserves the right to alter programmes and other details without prior notice.
7. Liability
Subject to the conditions outlined below, the Theatre shall be liable only for direct losses arising as a result of:
1. The breach of these terms and conditions by the Theatre; and/or
2. Any fraudulent statement or negligent act of the Theatre under or in connection with the Contract.
The Theatre’s total liability as referred to above shall be limited to the total face value of your Tickets.
8. Complaints Procedure
We request all customers raise any complaint at the time of their booking or visit, in order to allow our teams to attempt to resolve any issues that would constitute a breach of contract. Please email info@summerseatplayers.co.uk, or speak to one of our designated Front of House team in the event of any concern.
Please note that we are run entirely by volunteers and we do not operate a telephone complaints service. We endeavour to respond to all feedback within 21 days of receipt.
9. The Legal Bits
GDPR
Summerseat Players will collect, use, store and disclose your personal details in accordance with our Data Privacy Policy. All personal data is managed in accordance with appropriate UK and European data protection and freedom of information legislation. From time to time, we may film, photograph and/or record a production and members of the audience. Summerseat Players will endeavour to inform affected audience members prior to the commencement of the performance if such an image capture is to take place. Anyone not wishing to have their image shown may email us at info@summerseatplayers.co.uk to request removal.
Rights
To the fullest extent permissible in law, Summerseat Players shall be entitled to assign any of its rights or obligations under these Terms and Conditions.
None of the terms of this Agreement may be relied upon or enforced under the Contracts (Rights of Third Parties) Act 1999 by any third party that is not a party to this Agreement.
Nothing in these Terms & Conditions is intended to affect your statutory rights.
Entire Agreement
It is the intention of the Theatre that all the terms and conditions of the Contract are contained in these terms and conditions and no variation of the Contract will be valid unless set out in writing and signed by you and on behalf of the Theatre.
Severability
If any part or provision of these Terms & Conditions is found to be invalid or unenforceable, the invalid or unenforceable provision shall be severed or amended in such a manner as to render the rest of the provision/s and remainder of the Agreement valid or enforceable. Summerseat Players reserves the right to alter or amend these terms and conditions without prior notification.
Governing Law
These terms and conditions and any Contract incorporating them shall be governed by English law.
